Never before has the retirement living and the aged care sectors been challenged and scrutinised as they are today.  We understand these unique challenges and have the necessary know how and experience to assist operators to best position their business processes, facilities and management teams to stay one step ahead of regulatory challenges.

We are experienced in assisting retirement village and aged care operators with all aspects of the establishment and day to day operation of these facilities and will work collaboratively with you to provide easy to understand advice that delivers practical solutions to often complex problems.  We are also experienced in advising persons who intend to reside in a retirement village or aged care facility on their rights and obligations prior to them entering into agreements with operators.

Our Expertise

Our team is able to provide advice in relation to:

  • acquisition of the site for the retirement village scheme including assistance with due diligence enquiries
  • development and construction advice
  • planning advice for obtaining a development approval for the site for use as a retirement village and/or aged care facility
  • preparation of residence contracts (including any attachments such leases, licenses checklists for use by sales agents to ensure compliance with legislation and regulations)
  • preparation of Village Comparison Documents and Prospective Costs Documents (formerly known as Product Information Documents)
  • preparation of residential aged care agreements and aged care accreditation
  • preparation of practical checklists for use by employees and sales agents to ensure compliance with legislation and regulatory guidelines
  • advice on compliance with the Retirement Villages Act 1999 including review and amendment of existing documentation as required by recent changes to the Act
  • advice on the commercial terms of retirement village documentation, such as calculation of exit fees and also the subsidies that may be available to residents for the ongoing fees charged by operators
  • employment and occupational health and safety
  • claims from residents and patients including dispute resolution and litigation
