  • Building & Construction Law

Whether you are a builder, subcontractor or property owner, ensuring a smooth project with expert legal planning and protection can save you a great deal of time and money.
  • Our Practice

Our lawyers aim to give common sense legal advice to cover all stages of the building process including the formation of construction contracts through to the resolution of building disputes.

We act for property developers, homeowners, builders, subcontractors and associated professionals such as architects and engineers. We can advise clients on construction contracts and look to find creative, practical solutions to any problems that may arise during the building process.

We have represented both builders and building owners (both commercial and residential) in all courts and in the Building List of the Queensland Civil and Administrative Tribunal and have acted for a variety of subcontractors and principals in disputes arising under the Subcontractors' Charges Act and the Building and Construction Industry Payments Act.

    Our Expertise

Our team regularly provides advice in the following areas:

    • residential and commercial building contracts
    • the Domestic Building Contracts Act
    • claims by subcontractors
    • making and responding to claims under the Building and Construction Industry Payments Act and Subcontractors' Charges Act
    • noise, disturbance or structural complaints by neighbours in respect of building projects
    • building disputes and complaints to the Building Services Authority or Queensland Master Builders Association
    • encroachment issues
    • mediation or alternative resolution of building disputes
    • building covenants on small or large scale developments
    • debt recovery for builders, engineers, architects and subcontractors
    • defective building claims against builders, architects or engineers

The firm is also a member of the Queensland Master Builders Association, Property Council of Australia, Urban Development Institute of Australia (Qld Division) and Strata Community Australia. We have access to a wide range of resources to assist those in the building industry.

We also have considerable experience in the issues that may arise when a building contractor or subcontractor becomes insolvent. We regularly assist liquidators, receivers and managers, company administrators and bankruptcy trustees with the competing claims that can arise when a building contractor or subcontractor experiences financial difficulties.
