Your trademark may comprise a letter, word, phrase, sound, smell, shape, logo, picture or a combination of these provided it is capable of distinguishing your goods or services from those of other traders in the market place.

    As a registered owner of a trademark, you:

    • Have the exclusive right to you use your mark as a brand name for the protected goods or services.
    • Have an asset in the mark, which may be sold.
    • Have a registration which usually covers the whole of the Commonwealth of Australia. You are also able to apply to have the trademark registered internationally.
    • Can stop people from using your trademark as their brand name on goods or services for your trademark registration.
