Rod O'Sullivan

Director

Rod is a director in our litigation and dispute resolution team.  Rod concentrates particularly upon the resolution of property, leasing, building, and body corporate disputes, insolvency, insurance, intellectual property, and debt recovery.

Rod has over 25 years experience in all courts and a number of tribunals including the Building and Retail Shop Lease Lists of the Queensland Civil and Administrative Tribunal and before the Commissioner for Body Corporate and Community Management.

He is a member of the Housing Industry Association and Queensland Master Builders Association and regularly advises building owners, developers, builders, suppliers, and subcontractors in relation to building contracts and disputes, including claims under the Building Industry Fairness (Security of Payment) Act 2017.  He has particular experience in advising building owners, builders, and subcontractors of their rights and obligations when a party involved in a building project is insolvent or in financial distress. 

He acts for bodies corporate, building managers, and unit owners in disputes arising under the Body Corporate and Community Management Act 1997 and provides advice on the rights and obligations of people managing or living in community title schemes.  Rod's experience in building and construction matters make him particularly well placed to advise bodies corporate unit owners faced with building defects.

His debt recovery and insolvency work have exposed him to and given him an insight into a number of industries including retail and commercial leasing, property development, manufacturing, and transport.  He also provides advice to liquidators and bankruptcy trustees on insolvency-related matters.

Rod firmly believes that litigation is a process designed to resolve disputes and has experience in numerous dispute resolution processes including case appraisal, mediation, and pre-trial conferences. Rod has a Certificate in Mediation with a particular interest in construction, leasing, and body corporate disputes.
