We are experienced in assisting retirement village and aged care operators with all stages and aspects of the establishment and day to day operation of these facilities. We work collaboratively with our clients to provide easy to understand advice that delivers practical solutions to often complex problems. 

 

We are also experienced in advising proposed residents of retirement villages or aged care facilities on their rights and obligations prior to them entering into agreements with retirement villages or aged care operators. Our advice will ensure that you can take this step with a full understanding of the rights and obligations of all parties to the agreements.

Our Expertise

Our team provides advice relating to:

  • All dealings for the acquisition of the site for the retirement village scheme and/or aged care facility including corporate structure, due diligence inquiries, and conveyancing.

  • Planning advice and assistance for development approval to use the sit for a retirement village and/or aged care facility.

  • Commercial advice and assistance relating to all aspects of the business and the development including aged care accreditation and development and construction advice and agreements.

  • Advice on and preparation of Village Comparison Documents, Prospective Costs Documents, residence contracts, village by-laws and any other required documents including leases, licenses, and practical checklists for use by employees and sales agents to ensure compliance with legislation and regulatory guidelines.

  • Advice on compliance with the Retirement Villages Act 1999 including review and amendment of existing documentation as required by changes to the Act from time to time.

  • Advice on the commercial terms of retirement village documentation, such as calculation of exit fees and the subsidies that may be available to residents for the ongoing fees charged by operators.

  • Workplace issues such as employment and occupational health and safety.

  • Claims by residents and patients including internal and external dispute resolution, and litigation.
