Shand Taylor Lawyers is experienced in assisting retirement village operators with all aspects of the establishment and day to day operation of retirement villages.  We are also experienced in advising persons who intend to reside in a retirement village on their rights and obligations prior to them entering into agreements with operators.

Our Expertise

Our team is able to provide advice in relation to:

  • acquisition of the site for the retirement village scheme including assistance with due diligence enquiries
  • planning advice for obtaining a development approval for the site for use as a retirement village
  • preparation of residence contracts (including any attachments such leases, licenses checklists for use by sales agents to ensure compliance with legislation and regulations)
  • preparation of Village Comparison Documents and Prospective Costs Documents (formerly known as Product Information Documents)
  • preparation of practical checklists for use by employees and sales agents to ensure compliance with legislation and regulatory guidelines
  • advice on compliance with the Retirement Villages Act 1999 including review and amendment of existing documentation as required by recent changes to the Act
  • advice on the commercial terms of retirement village documentation, such as calculation of exit fees and also the subsidies that may be available to residents for the ongoing fees charged by operators
