Not such a great deal after all? Landlords or Tenants unhappy with their the COVID-19 rental relief

The Retail Shop lease and Other Commercial Leases (COVID-19 Emergency Response) Regulation 2020 (the Regulation) enacted by the Queensland Government in late May 2020 provided a framework for landlords and tenants to agree on rent relief for tenants affected by COVID-19.


The Regulation also allows a party to a COVID-19 affected lease to issue a notice of dispute to the Small Business Commissioner after 31 December 2020 if that party is concerned the other party has not complied with the Regulation.


The Regulation will expire on 30 September 2021.


After this date tenants or landlords under a retail or commercial lease will no longer be able to dispute the rent relief arrangements made for the period between 29 March 2020 and 31 December 2020.
